The Individuals with Disabilities Education Improvement Act of 2004 (IDEIA, 2004) requires all school districts, including Duval County Publics Schools (DCPS) to engage in timely and meaningful consultation with private school representatives and with parents, and parent’s representatives about the design and development of special education and related services for parentally placed private school students (“PPPSS students”).
Consultation includes individual or group meetings, telephone and face-to-face conferences, emails, surveys or other effective and efficient processes. DCPS has engaged in these various processes throughout the school year. IDEIA, 2004 also requires DCPS to ask private school representatives to provide written affirmations of a satisfactory consultation process. The consultation process includes the following topics: · The child find process and how PPPSS students suspected of having a disability can participate equitably, including how parents, teachers, and private school officials will be informed of the process; · The determination of the proportionate amount of Federal funds available to serve such students, including the determination of how the amount will be calculated; · The consultation process among DCPS, private school officials, parents and representatives of parents, including how such process has, and will, operate throughout the school year to ensure that students identified through the child find process can meaningfully participate in special education and related services; · How, where, and by whom special education and related services will be provided, including a discussion of types of services, including direct services and alternate service delivery mechanism, how such services will be apportioned if funds are insufficient to serve all PPPSS students, and how and when these decisions will be made; and · How, if a private school official disagrees with DCPS on the provision of services or types of services, DCPS will provide a written explanation of its decision to the private school official.
Provision of equitable services shall be provided by employees of DCPS or through contract(s) with DCPS and individuals, associations, agencies, and/organizations. Special education and related services provided to such students, including materials and equipment, shall be secular, neutral, and nonideological. DCPS shall control the funds used to provide special education and related services, as well as the ownership of materials, equipment, and property purchased with IDEIA funds.
I, the undersigned authorized representative of the nonprofit private school named below, affirm that Duval County Public Schools has provided timely and meaningful consultation in accordance with the requirements of the Individuals with Disabilities Education Improvement Act of 2004. In addition, I affirm that the school named below is a lawfully organized nonprofit in good standing under applicable federal and Florida laws. I will advise DCPS immediately should the school lose its nonprofit status. Please submit by February 14, 2025.
